Terms of Service

These Terms of Service ("Terms") govern your access to and use of KickHive ("we", "us", "our"), a sneaker collection management platform operated from Australia. By creating an account or using the Service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not use KickHive.

You must be at least 13 years of age to use KickHive. By using the Service, you represent that you meet this requirement.

Private Beta: KickHive is currently in private beta. Access is by invitation only. You must have received a valid invitation from KickHive or an existing member to create an account. Attempting to circumvent the invitation system is a violation of these Terms.

KickHive provides tools for sneaker enthusiasts to:

• Track and manage their personal sneaker collection (the "Hive")
• Monitor estimated market values using publicly available resale data
• Manage a want list with price targets
• Organise collections into custom groups
• Scan or identify sneakers using AI and barcode recognition
• Discover trending sneakers and market movements
• Share their collection via a public profile

All market prices, valuations, and resale estimates displayed in KickHive are for informational and entertainment purposes only. They are estimates derived from publicly available third-party data sources (StockX, GOAT, eBay, Flight Club and Stadium Goods) and are subject to change without notice.

• Prices shown are not financial advice and should not be relied upon for investment or purchasing decisions
• Actual resale prices may differ materially from estimates shown
• KickHive is not responsible for any financial loss resulting from decisions made based on pricing data displayed in the app

Pro Plan pricing:

• Monthly: USD $6.99 / month
• Annual: USD $59.99 / year (save ~29%)

Founding Member pricing (locked for life):

• Monthly: USD $2.49 / month
• Annual: USD $22.99 / year
• Founding Member pricing is available to qualifying early members. This rate is guaranteed for as long as you maintain an active subscription without lapsing.

Elite Plan pricing:

• Monthly: USD $12.99 / month
• Annual: USD $109.99 / year

Billing and cancellation:

• Subscriptions are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time via the Settings page. Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial periods, except as required by Australian Consumer Law
• Payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service

Price changes: We reserve the right to change subscription pricing with at least 30 days' written notice to existing subscribers. Founding Member rates are exempt from price increases as described above.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, scrape, or extract data from the Service in bulk
• Create multiple accounts to circumvent free tier limits
• Upload or share content that is offensive, defamatory, or infringes third-party rights
• Interfere with or disrupt the integrity or performance of the Service
• Use automated bots or scripts to access the Service without our written permission

You retain ownership of the content you add to KickHive (collection entries, notes, images). By using the Service, you grant KickHive a non-exclusive, worldwide, royalty-free licence to store, display, and process your content solely for the purpose of providing the Service.

If you choose to make your profile or collection public, you grant KickHive permission to display that content to other users and the general public.

You are responsible for ensuring that any content you upload does not infringe the intellectual property rights of any third party.

KickHive displays data sourced from third-party platforms including StockX, GOAT, eBay, Flight Club and Stadium Goods. This data is used under fair use principles for informational purposes. KickHive is not affiliated with, endorsed by, or partnered with StockX, GOAT, eBay, Flight Club, Stadium Goods, or any sneaker brand.

All sneaker names, brand names, and product images are the intellectual property of their respective owners. Their appearance in KickHive is solely for the purpose of personal collection tracking.

Your use of KickHive is subject to our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Market pricing data will be accurate, complete, or current
• The Service will meet your specific requirements

To the maximum extent permitted by Australian law, KickHive and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

In any case, our total liability to you for all claims arising from or relating to the Service shall not exceed the total amount you paid to KickHive in the 12 months prior to the event giving rise to the claim, or AUD $100, whichever is greater.

Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law that cannot be excluded by contract.

You agree to indemnify and hold harmless KickHive and its operators from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice where possible. We are not liable to you or any third party for any such changes.

We may introduce new features, change existing features, or adjust tier limits at our discretion.

You may delete your account at any time via the Settings page. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by contract. If you are an Australian consumer, you may have statutory guarantees that apply to the Service.

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or in-app notification. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.
